What you
can and can't do and say on forums:
This is getting a little out of hand,
with comments posted on forums, comments
about different products offered for
sale - Personal and slanderous comments
about known racing personalities,
Product Names and so on. Nearly all of
the racing products sold.
I've been getting correspondence from
all of my Authors and associates about
this for such a long time now, Plans
have now been implemented to rectify the
situation.
This has been dealt with on certain
forums over the past few months. It's
been necessary to make it very, very
clear, that when one is a member of
these forums, whatever your opinion is
about any racing product or any racing
personality whether it is justified or
not. These comments simply cannot be put
all over the internet in chat areas and
racing forums.
libelous -
personally insulting and certainly a
breach of copyright
Many comments made are libelous -
personally insulting and certainly a
breach of copyright. This has been
ignored for years fully understanding
and believing everyone has a right to
their opinions but when it comes to open
discussion, posting people's copyright
material up in these racing forums
etc.etc.etc ........ and making
slanderous statements, and making
publications freely available for
download, then someone sooner or later
is going to make a move to halt this
common practice.
Most of this has been dealt with but
there are many who ignore the advice.
Forum owners
and the members who make the posts are
liable
When it comes to libelous statements and
copyright breach, forum owners and the
members who make the posts are liable,
whether they consider owning a
Ltd/Inc/Pty Company etc. as protection
or not.
This has been pointed out in detail in
recent times. Taking these things
further especially in the UK will cost
anything from a 1£million upwards for
either party whatever the outcome.
After much communication with an attempt
to reach solutions in an amicable
manner, in the end the question was
asked, do the forum owners or members
really want to take this route? For the
most part this has been fully
understood. A solution had been found.
Forum owners have a
responsibility to make sure these type of posts are not
allowed - This should always be in the forum terms of use.
Moderators have the responsibility to ensure the terms are
adhered to.
If you have a problem with any product, Just go straight to
the publisher
Look, I don't even agree with half the products that are on
the internet but I don't go plastering it all over the place
by name. I don't even believe it is my place to make the
comments anyway.
Those publications are there so that you know about them. If
you think they look good and can help, well, that should
always be your choice.
The simple answer is this, if you buy the book and feel it's
rubbish, simply get a refund. All books offered ALWAYS have
an immediate refund policy in place
Here's a suggestion, if you are a member of a horse racing
forum, or you have a friend who is, AND you or your friend
have made similar comments about ANY products. Go and remove
them now or request that the forum owner does it for you.
When you have a problem with a product or person, just go
straight to them about it.
This is friendly advice to those who do this. You have to
remember, The Name and Product Name are all part of
International Publishing Organizations. - Trademarks -
Copyright - Registered and so on.
Even if they wanted to change things, by law they can't it's
all required. It eventually damages people's reputations
which in turn damages the products reputation and sales and
so on, all of which the publishers don't have much control
over. There are agents and sub publishing companies... well
it's too involved to go into, I don't want to write it and
you don't want to read it, but it affects so many other
people and businesses.
Do a friend a favor and pass this article
onto them!
